In some instances, Discover may provide your Card Information to third parties with agreements in place that govern its collection, use, sharing and protection. Such agreements do not supersede these Terms; rather they apply as additional terms of usage for Discover Click to Pay; it is your responsibility to ensure you read and comprehend such agreements before using Discover Click to Pay.

Discover is always open to receiving Feedback about its functionality and features of Discover Click to Pay, including functionality or features that require improvement. By providing Feedback you agree that Discover has a royalty-free, perpetual, non-exclusive worldwide license to utilize such Feedback in any manner it sees fit.

Discover reserves the right to suspend or terminate your use of Discover(r) Click to Pay and access to your Profile at any time, with or without cause, in its sole discretion. Any such suspension or termination shall not alter your obligation to make payments as set out hereunder in case of default or breach.

Unless otherwise agreed in writing by both Discover and you, any disputes regarding these Terms (or relationships that result from them) or relationships that arise as a result will be settled through binding arbitration. Exceptions include small claims courts or equivalent state-based proceedings brought under state law; also claims in which either Discover or you seeks to enforce or challenge this arbitration agreement and attempt to challenge its validity are exceptions from this rule; both you and Discover agree to forgo their right to jury trials when dealing with such Claim(s).

At any point in time and without cause, these Terms do not create an agency, joint venture, or employment relationship between you and Discover. Furthermore, no third-party may assign these Terms without Discover’s prior written approval; or delay or fail to enforce their rights and remedies under these Terms at any point without providing any explanation whatsoever.
